Mass. Sues Over Definition of Marriage
By DENISE LAVOIE
BOSTON (July 8) – Massachusetts, the first state to legalize gay marriage, sued the U.S. government Wednesday over a federal law that defines marriage as a union between a man and a woman.
The federal Defense of Marriage Act interferes with the right of Massachusetts to define and regulate marriage as it sees fit, Massachusetts Attorney General Martha Coakley said. The 1996 law denies federal recognition of gay marriage and gives states the right to refuse to recognize same-sex marriages performed in other states.
The lawsuit, filed in federal court in Boston, argues the act "constitutes an overreaching and discriminatory federal law." It says the approximately 16,000 same-sex couples who have married in Massachusetts since the state began performing gay marriages in 2004 are being unfairly denied federal benefits given to heterosexual couples.
"They are entitled to equal treatment under the laws regardless of whether they are gay or straight," Coakley said at a news conference to discuss the lawsuit.

Happy Easter to all that celebrate it! We had about 15 people over today. One of my sister couldn't make it because she had to work so after everybody left we drove down to her house and visited. It was a pretty good day in all. Oh, I found out that the father of my niece's boyfriend is a guy I had a huge crush on when I was in high school. Talk about a small world!
When did people stop putting spoiler alerts for their fic?! I'm so behind in some of my shows so I have ended up skipping many fics cause I just don't know if it has any. Another thing I've notice is less and less people write a summary for their fics.
Speaking of fics, I found another prompt community I think I might join. Yes, I'm crazy!
Wow, Feb 17th was my last post? Doesn’t seem that long. Stuffs been pretty crazy around here lately. We had unexpected company, well, we had about a week's notice so thre was major speed cleaning going on. I’ve also had family members in the hospital and a bunch of other crap. I’ve tried to check lj everyday but just haven’t had time to really comment or anything.
I cleaned out my hall closet earlier and now my face is itching like crazy. Actually I didn’t start out to clean it. I was just looking for something, which I didn’t find. So now I have no idea where it is. *sigh*
So how are you all doing?
Senate Bill 68, which is nearly identical to a law Arkansas voters approved in November, would ban anyone "cohabitating with a sexual partner outside of marriage" from becoming a foster or adoptive parent.
That would include relatives of children removed from homes because of abuse or neglect.
"It would be an irresponsible bill because of the potential foster and adoptive parents it categorically eliminates," said Chris Hartman, director of the Fairness Campaign, a Louisville gay-rights group that opposes the measure.
Though SB 68 would apply to heterosexual unmarried couples as well as same-sex couples, Hartman's group characterized it as "an anti-gay political attack."
The bill's sponsor, Sen. Gary Tapp, R-Shelbyville, could not be reached yesterday. The bill is pending before the Senate Judiciary Committee, whose chairman, Sen. Robert Stivers, R-Manchester, also couldn't be reached.
Kentucky has about 7,100 children in foster care and is working to recruit more foster parents, state officials said.
The state is seeking adoptive homes for about 2,000 of those children, according to the Cabinet for Health and Family Services.
